제1장 총칙

제1조(목적) 이 권리장전은 제주대학교 대학원생이 가지는 불가침의 기본적 인권을 보호하고 그 수준을 향상시킴으로써 인간으로서의 존엄과 가치 실현에 이바지함을 목적으로 한다.

제2조(정의) ① 이 권리장전에서 “대학원생”이란 제주대학교 대학원의 석사과정, 박사과정 및 석·박사통합과정의 학생을 말한다.

② 그 밖에 이 권리장전에 정의되지 않은 기본적인 용어는 법령 및 학칙에 기재된 정의 또는 사회통념상 인정되는 정의와 같다.

제3조(기본원칙) ① 대학원생은 교직원과 함께 제주대학교 대학원의 구성원으로서 존중받을 권리가 있다.

② 대학원생은 어떠한 신체적, 언어적, 성적 폭력으로부터 자유롭고 안전한 환경에서 학습하고, 연구하고, 근로할 권리가 있다.

③ 대학원생은 성별, 학력, 국적, 인종, 나이, 장애, 종교 또는 정치적 성향 등으로 인해 차별받지 아니한다.

④ 대학원생의 건강, 안전, 혼인과 모성의 보호, 가족생활 등 개인의 존엄과 가치에 관계된 사항은 학업과 연구보다 우선한다.

제2장 대학원생의 권리

제4조(자기 결정권) 대학원생은 사생활의 자유를 가지며, 부당한 이유로 이를 침해받아서는 아니 된다.

제5조(학업과 연구에 관한 권리) ① 대학원생에게 보장된 학업과 연구의 기회가 부당하게 박탈되어서는 안 되며, 학위과정을 마칠 때까지 정당하지 않은 이유로 학업이 중단되지 않을 권리를 가진다.

② 대학원생은 자신의 전공과 연구주제에 관해 전문적인 수업, 연구, 훈련 및 지도를 받을 권리를 가진다.

③ 대학원생은 학업과 연구에 필요한 연구 공간 및 학내 지원시설을 정당하게 이용할 권리를 가진다.

④ 대학원생의 석사？박사 학위취득을 위한 진척 수준은 객관적 기준에 따라 평가되어야 하며, 평가 결과는 서면 또는 면담으로 공유되어야 한다.

제6조(지식재산권) ① 대학원생은 연구 아이디어 제시, 연구과정 참여 등 자신이 상당 부분 기여한 연구 출판물에 공저자로 등록될 권리가 있다.

② 대학원생은 해당 분야의 학계에서 일반적으로 인정되는 자신의 주도적이고 독창적인 아이디어와 연구방법을 기반으로 한 연구 결과에 대해 주저자로서의 저작권 등 지식재산권을 가진다.

제7조(공정한 심사를 받을 권리) ① 대학원생은 자신의 연구 결과에 대해 공정한 심사를 받을 권리가 있다.

② 평가항목은 구체적이고 객관적이어야 하고, 과정은 투명하고 공정하게 이루어져야 하며, 그 결과는 적절한 방법으로 제공되어야 한다.

③ 대학원생은 자신의 학업 및 연구결과 평가에 대해 평가자에게 이의를 제기할 수 있으며, 평가자는 이에 대해 충분히 설명하여야 한다.

제8조(의사결정에 참여할 권리) ① 대학원생은 이 권리장전에 명시된 권리들이 실현되는 과정에 참여할 수 있는 권리를 가진다.

② 대학원생은 대학원 자치조직을 구성？운영하고 그 활동에 참여할 권리를 가진다.

③ 대학원생은 대학원생의 학업 및 연구와 관련된 제주대학교의 결정과 그 내용에 대하여 의견을 개진할 권리를 가진다.

제9조(근로제공에 따른 권리) ① 대학원생은 조교, 연구조교, 연구과제 연구원 등으로 채용되는 과정에서 채용 조건과 방식을 구체적으로 알 권리가 있고, 공정한 채용심사를 받을 권리를 가진다.

② 대학원생으로부터 학문적？육체적 근로를 제공받는 사람은 명확한 근로시간, 근로내용, 임금기준의 정보를 제공하고 이를 준수하여야 한다.

제3장 대학원생의 보호

제10조(부당한 일에 대한 거부권) 대학원생은 자신의 학업 및 연구와 관계가 없는 부당한 일을 거부할 권리를 가진다.

제11조(지도교수 변경의 권리) ① 지도교수는 학위논문 및 연구지도에 주된 역할을 담당하며, 학생을 성실히 지도하여야 한다.

② 지도교수의 휴직, 파견 및 그 밖의 사유로 학생을 지도할 수 없는 경우에는 학생이 지도교수 변경을 요청할 수 있다.

③ 학과 주임교수가 제2항의 사유가 타당하다고 인정하는 경우에는 학생 본인이 신청으로 지도교수를 변경할 수 있다.

제12조(해결절차) ① 대학원생이 위에서 명시된 권리를 침해당하는 경우 공식적으로 문제를 제기할 수 있는 절차에 대한 정보를 제공받을 권리를 가진다.

② 대학원생은 권리침해 사실 통보에 따른 어떠한 불이익도 받아서는 아니 된다.

③ 위원회 등 문제해결기구가 열리는 경우 비공개 원칙이 보장되어야 하며, 대학원생은 증거와 증인을 자유롭게 채택할 수 있다.

제13조(대학 구성원의 책무) ① 대학원의 모든 구성원은 이 권리장전에 명시된 권리를 알고 이를 존중하고 실현해야할 책임을 가진다.

② 대학원은 이 권리장전을 구성원들에게 알려 제1항의 책무를 다할 수 있도록 노력하여야 한다.

제14조(그 밖의 권리) 대학원생의 권리는 이 권리장전에 열거되지 아니하였다는 이유로 경시되지 아니한다.

제4장 대학원생의 의무

제15조(학칙 준수) 대학원생은 학내 정해진 절차와 학칙 및 규정 등을 성실히 준수하여야 하며, 제주대학교의 명예가 실추되지 않도록 노력할 의무가 있다.

제16조(학업 및 연구) ① 대학원생은 본분인 학업과 연구를 성실히 수행하여야 한다.

② 대학원생은 학내 공간과 지원시설을 책임감 있게 사용하여야 하며, 안전지침을 성실히 준수하여 안전한 연구환경을 조성할 의무가 있다.

제17조(연구윤리) ① 대학원생은 연구의 제안, 수행, 결과 보고 및 발표 시 위조, 변조, 표절 또는 부당한 논문저자 표시 등 연구 진실성에 반하는 행위를 하지 않아야 한다.

② 대학원생은 참여하고 있는 연구과제의 연구비 집행지침을 준수하고, 그 기준에 맞게 공정하고 투명하게 연구비를 사용할 의무가 있다.

제18조(조교 및 연구원 등) 조교, 연구조교, 연구과제 연구원 등으로 채용된 대학원생은 정해진 근로시간, 근로내용 등을 성실히 준수할 의무가 있다.

부칙(2016. 6. 21.)

이 권리장전은 공포한 날부터 시행한다.

Jeju National University Graduate Student Bill of Rights

Enacted June 21st, 2016

Chapter 1: General Provisions

Article 1 (Objectives): This Bill of Rights aims to contribute to the realization of values and dignity as human beings by safeguarding the fundamental human rights of Jeju National University's graduate students.

Article 2 (Definitions): ① In this Bill of Rights, "graduate student" refers to a student who is enrolled in a master's course, Ph. D course, and/or a combined masters-doctorate course at Jeju National University Graduate School.

② Other basic terms that are not defined in this Bill of Rights are the same as those defined in acts, decrees, the school regulations or the generally-accepted ideas of society.

Article 3 (Basic Principles): ① Graduate students have a right to be respected as members of the Graduate School of Jeju National University along with faculty members.

② Graduate students have a right to study, research, and work in a safe environment free of any physical, verbal, or sexual violence.

③ Graduate students should not be discriminated against based on characteristics such as gender, academic background, nationality, race, age, disability, religious beliefs, or political beliefs.

④ The Graduate School should prioritize matters related to individual dignity and values of graduate students such as health, safety, marital and maternity protection, and family life over study and research.

Chapter 2: Rights of Graduate Students

Article 4 (Rights of Self-Determination): Graduate students have a right to privacy that should not be infringed upon for unfair reasons.

Article 5 (Rights Regarding Study and Research): ① Graduate students should not be unduly deprived of academic and research opportunities, and have a right not to be suspended from school for unfair reasons until the completion of their program.

② Graduate students have a right to receive professional instruction, research, training, and guidance on topics related to their major and research.

③ Graduate students have a right to access to appropriate offices, laboratories and classrooms.

④ The level of progress toward graduate students' masters or doctoral degrees should be assessed according to an objective criteria, and the results should be shared in writing or in verbal interviews.

Article 6 (Intellectual Property Rights): ① Graduate students have a right to be registered as co-authors in publications for significant efforts and contributions to cooperative research projects.

② Graduate students have intellectual property rights, such as copyrights, if they are the lead author of research results, comprising primarily of their unique research methods that are still consistent with the conventions of the field.

Article 7 (Rights to Receive an Unbiased Judging Process): ① Graduate students should be given a fair opportunity to correct or remedy deficiencies in their research results.

② The evaluation items should be specific and objective; the process should be transparent and fair; and the results should be provided in an appropriate and timely manner.

③ Graduate students may appeal the assessment of academic or research-driven work, in which case the evaluator should provide a full explanation.

Article 8 (Rights to Participate in the Decision-Making Process): ① Graduate students have a right to participate in the realization of the rights set forth in this Bill of Rights.

② Graduate students have a right to organize and operate a self-governing organization within the graduate school and participate in its activities.

③ Graduate students have a right to state their opinions on the decisions and contents related to the study and research of graduate students at Jeju National University.

Article 9 (Rights Regarding an Offer of Labor): ① Graduate students have a right to be informed of the conditions and methods of recruitment and to be judged in accordance with fair procedures in the process of recruitment as assistants, research assistants, or researchers for projects.

② Those who receive academic and physical work from graduate students should provide and comply with clear working hours, job duties, and wage standards.

Chapter 3: Protection of Graduate Students

Article 10 (Rights to Refuse Unfair Tasks): Graduate students have a right to refuse to perform tasks that are not closely related to their academic programs or professional development.

Article 11 (Rights to Request a Change of Academic Advisor): ① An academic advisor should play a leading role in dissertation and research guidance, and should faithfully instruct students.

② In case students are unable to be taught due to an academic advisor’s leave of absence, dispatch, or any other reason, the students may request a change of academic advisor.

③ If the head professor of the department admits that the reason for paragraph 2 is rational, the students themselves can request to change their academic advisor by submitting an application.

Article 12 (Solution Processes): ① If the rights outlined in this document are breached, graduate students have the right to be provided with information on official academic grievance procedures.

② Graduate students should not be disadvantaged in any way for raising cases of infringement.

③ If a problem solving organization such as a school board is held, non-disclosure should be guaranteed. Graduate students are free to provide both evidence and witnesses.

Article 13 (Responsibilities of the University Members): ① Every member of the Graduate School has the responsibility to be fully aware of, respect, and realize the rights set forth in this Bill of Rights.

② The Graduate School should make this Bill of Rights known to its members and endeavor to fulfill the responsibilities set forth in paragraph 1.

Article 14 (Other Rights): Other rights are not neglected even though they may not be listed in this Bill of Rights.

Chapter 4: Responsibilities of Graduate Students

Article 15 (Obeying School Rules): Graduate students are required to faithfully comply with established procedures, rules and regulations in school, and have an obligation to make efforts to ensure that the honor of Jeju National University is not damaged.

Article 16 (Study and Research): ① Graduate students should perform their duties of academic studies and research earnestly.

② Graduate students should use the school space and supporting facilities responsibly, and should observe the safety guidelines in order to create a safe research environment.

Article 17 (Research Ethics): ① Graduate students should not engage in activities contrary to the truth and dignity of research, such as counterfeit, falsification, plagiarism, or display of unjustified authors when they suggest, carry out, or present the research.

② Graduate students are obliged to abide by the guidelines of the research fund for their projects, and to use the research fund fairly and transparently in accordance with the standards.

Article 18 (Assistants and Researchers): Graduate students employed by assistants, research assistants, or researchers for project are obliged to faithfully observe prescribed working hours and work requirements.

Supplementary Provisions 21 June 2016

This Bill of Rights shall enter into force on the day of its promulgation.
